Terms and Conditions of Rental Properties of Shorebirds Beach Cottages of Manasota Key LLC
These Terms and Conditions clarify Shorebirds Beach Cottages of Manasota Key LLC’s obligations to The Renter, The Renter’s obligations to Shorebirds Beach Cottages of Manasota Key LLC. In the unlikely event of any disputes, these Terms and Conditions will be used as a basis for any resolution.
PLEASE READ THE FOLLOWING INFORMATION ABOUT MAKING YOUR RESERVATION AND THE TERMS AND CONDITIONS OF RENTAL AGREEMENT

Acceptance of these Terms & Conditions binds a contract between the following two parties:
The Rental Applicant (the Lead Renter) and Shorebirds Beach Cottages of Manasota Key LLC.
- Party Members: The Rental Applicant and Rental Group (Guests of Lead Renter) will be bound by the terms and conditions of this agreement. The Rental Applicant is considered to be the Lead Renter and will assume full responsibility for all members of the Rental Group (Guest of Lead Renter) throughout the rental period. A Rental Group (Guests of the Lead Renter) are authorized occupants of the Lead Renter and may be family members or friends of the Lead Renter. Use of the premises will be denied to persons not falling within the foregoing categories. Should any unauthorized persons occupy or use the premises, the Lead Renter and all occupants shall vacate the premises immediately without any refund. Information or instructions relating to this rental will be communicated to the Rental Applicant only and not to any third-party member of the Rental Group.
- Default: If the Lead Renter and Rental Group should fail to comply with the conditions and obligations of this Agreement, The Lead Renter and Rental Group shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred. Lead Renter agrees to pay all reasonable costs, attorney’s fees, and expenses that shall be made or incurred by Shorebirds Beach Cottages LLC and its owners enforcing this agreement.
- Occupancy of the Property: The maximum number of overnight guests per cottage is limited to (6) persons (children included) and a maximum of 4 adults in the White Pelican and Laughing Gull, and 5 adults in the Piping Plover and Oystercatcher cottages. The stated agreed occupancy figure includes all persons irrespective of age, day and overnight guests. Exceeding the number of stated and agreed guests on the rental agreement will result in immediate eviction without refund or a charge of double the room rental rate and of the housekeeping fee.
- Visitors of Rental Applicant: The maximum number of daytime visitors per cottage is limited to two (2) persons. All daytime visitors are permitted on the property between the hours of 8:00am and 10:00pm. The Lead Renter is responsible for notifying Shorebirds Beach Cottages of Manasota Key LLC management if the maximum number of daytime visitors needs to be increased. Visitors are not permitted to use kayaks, paddle boards or bicycles, as they are reserved for registered guests of Shorebirds Beach Cottages LLC only.
- Video Surveillance: Shorebirds Beach Cottages of Manasota Key LLC has exterior cameras monitoring common areas (ie. patios, bikes, kayaks, paddle boards, driveways and walkways) on the property. This video footage is not shared and is recorded for liability purposes and to monitor occupancy and other policies in the rental agreement. Any attempt at disabling, redirecting, or obscuring the cameras is prohibited and may result in immediate eviction without refund. Guests shall see to their own security while in or on the property by locking doors, window, and vehicles.
- Assignment of Sublease: Rental Applicant shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Rental Applicant and included within the number of and permitted occupants under this agreement.
- Minimum Age: Shorebirds Beach Cottages of Manasota Key LLC has a minimum age for renting. The Lead Renter must be at least twenty-five (25) years of age and will be an occupant of the cottage during the entire rental period. No key code will be issued to anyone who is not at least twenty-five (25) years of age or accompanied by an adult guardian or parent. Shorebirds Beach Cottages of Manasota Key LLC reserves the right to refuse service to anyone.
- Payments: A reservation will be confirmed by Shorebirds Beach Cottages of Manasota Key LLC management once the Rental Agreement has been approved and initial or full payment has been processed. For reservations of one week or more, if the reservation is made 60 days or more before the rental commences, an initial rental deposit of 50% of the rental fee will be due at the time of booking. Sixty days prior an additional payment of 25% of the rental fees will be due, with the final payment due 30 days prior to the commencement of rental. The initial rental deposit is not a security or damage deposit. If a reservation is made less than 45 days before the rental commences, or the reservation is less than a full week’s duration, the full rental fee must be paid at the time of booking. In the event of a reservation not being accepted by Shorebirds Beach Cottages of Manasota Key LLC management, all fees paid will be refunded immediately. Any booking made within 10 days of the start of the rental period must be paid in full using a major credit card at the time of booking. No reservation may commence without full payment being cleared. Once a reservation is received and accepted by Shorebirds Beach Cottages of Manasota Key LLC management, the Rental Applicant is liable for payment of the balance of the rental amount thirty (30) days before occupation of the property. If payments are not received on time or if the Rental Applicant’s credit card is declined, the reservation may be cancelled and previous payments become non-refundable in compliance with the cancellation policies listed below.
- Cancellation Policy: Once a reservation has been accepted and confirmed, a cancellation can only be made in accordance with the terms below:

- If reservation is cancelled sixty (60) days prior to arrival date, one hundred percent (100%) of the rental amount will be refunded.
- If reservation is cancelled thirty (30) days prior to arrival date, fifty percent (50%) of the rental amount will be refunded.
- There are no refunds for reservations cancelled within thirty (30) days of the arrival date.
- Early departure does not warrant any type of refund.

10. Damage Waiver: Shorebirds Beach Cottages of Manasota Key LLC management charges a one-time property Damage Waiver Fee based on the length of the rental period, which covers loss or damage by Guests to the property or equipment during your stay. This non-refundable fee will cover the Lead Renter and the Rental Group for unintentional damage at the Property reserved. Please be advised that intentional damage, gross negligence, pet damage, re-keying, property damage resulting from motorized vehicles or watercraft use, additional cleaning if the home is left excessively dirty or invoices for damages associated with your rental that may be presented subsequent to your occupancy are not covered by the Damage Waiver Fee and the Lead Renter will be charged for damages of this nature. Where loss or damage to the Property, the inventory or equipment exceeds $1000, Shorebirds Beach Cottages of Manasota Key LLC management will bill the Lead Renter for the shortfall, Shorebirds Beach Cottages of Manasota Key LLC managers/owners reserve the right to exercise any legal remedies to pursue the amount owed from the Lead Renter. The Damage Waiver fee does not cover damage or loss that is not disclosed. To avoid erroneous blame, the Lead Renter is required to immediately notify Shorebirds Beach Cottages of Manasota Key LLC management of any incidents of loss or damage that have occurred during the occupancy of the property. Shorebirds Beach Cottages of Manasota Key LLC management reserves the right to determine the nature, extent, and expense associated with any damage.
11. Confirmed Booking: Upon receipt of the initial reservation and required payment from Rental Applicant, Shorebirds Beach Cottages of Manasota Key LLC management will issue a Rental Agreement by email, facsimile, or postal mail to the Rental Applicant. Only upon receipt of the signed Rental Agreement is the booking determined as confirmed.
12. Condition and Use of the Property: The Property will have been inspected prior to occupation and therefore, the Lead Renter undertakes to :

- Notify Shorebirds Beach Cottages of Manasota Key LLC management immediately with regard to any damage and/or maintenance issues that require attention.
- Keep the property and all furniture, fixtures, chattels, and effects in or about the Property in the same state of repair and condition as found at the commencement of the rental.
- All windows and doors must remain closed during inclement weather.
- The Lead Renter shall follow the departure instructions provided by Shorebirds Beach Cottages of Manasota Key LLC management.
- Keep the air conditioner no lower than 73 degrees and the heater no higher than 74 degrees.

13. Unavailability of the Property: In the event the Property is not available for use during the Rental Term due to reasons, events, or circumstances beyond the control of Shorebirds Beach Cottages of Manasota Key LLC management, Rental Agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Lead Renter. If such replacement property cannot be found and made available, Rental Agent shall immediately return all payments made by Lead Renter, whereupon this Agreement shall be terminated and Lead Renter and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.
14. Travel Insurance: If you are concerned about the possibility of a last-minute cancellation or early departure, Shorebirds Beach Cottages of Manasota Key LLC management strongly recommends that you take responsibility for this risk and purchase travel insurance.
15. Falsified Reservations: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party shall not be permitted to check-in or may be evicted.
16. Basis of Rental: Properties offered for short-term rental through Shorebirds Beach Cottages of Manasota Key LLC management are provided on a self-catered basis. Shorebirds Beach Cottages management provides one (1) bottle of soap and shampoo, and three (3) rolls of bathroom tissue per bathroom, one (1) bottle of liquid dish soap, three (3) trash can liners, and one (1) roll of paper towels as complimentary starter items for each rental period. Once these starter items are used, it is the Guests responsibility to replenish the items needed for themselves through their length of stay.
17. House Cleaning: A cleaning fee is charged for each unit reservation. On departure, leave sheets on all used beds and unmade. Place used towels in the bathroom shower. All dinnerware, pots, pans, glasses should be cleaned and put away. Please remove/discard any food items from cabinets and refrigerator/freezer. Trash should be removed from the cottage and placed in the proper receptacles outside. The cleaning service will arrive shortly after 10:00am check out time. No cleaning service is provided during the Guest’s stay unless prior arrangements have been made through management.
18 Laundry: The Property is equipped with a community washer and dryer for your convenience. Leave washer door open after completing laundry to dry washer out and prevent mold or mildew. Clean lint tray after each dryer use to prevent fires. If using laundry soap pods, place them inside the washer drum and never in the drawer where only liquid soap should be placed.
19. Pets: No animals of any kind will be brought onto the premises without the expressed permission of the owners. Small dogs less than 30 pounds are ONLY considered for monthly or greater reservations during the January to April season with prior approval from Shorebirds Beach Cottages of Manasota Key LLC management. Lead Renter must read and acknowledge the Dog Addendum. Non-refundable pet fees starting at $150 are applied for any approved pet. All pets must be leashed at all times. The Lead Renter is responsible for cleaning up of any/all pet refuse. Pets are not permitted on any item of furniture, including beds, and evidence of pets on furniture or bedding will incur additional cleaning charges. Pets are to be treated with a topical flea and tick repellent three (3) days prior to arrival. Fleas and ticks are rampant in this area and can cause harmful/fatal illness to humans and pets. The Lead Renter should prevent pet(s) from producing excessive noise at a level that disturbs other guests or neighbors. Pet will not be left unattended for an undue length of time, either indoors or out. Pet will not be left unattended on patio, porch or other outdoor spaces. All evidence of pet occupation must be removed from the Property and grounds at the end of the rental period. The Lead Renter is required to complete the Pet Addendum in accordance with the Terms and Conditions of the rental agreement.
20. Children: Shorebirds Beach Cottages of Manasota Key LLC properties are not childproof nor does the management of Shorebirds Beach Cottages of Manasota Key LLC represent them as such and thus requires children to be supervised by an adult at all times. Amenities such as furniture with sharp edges, fireplaces, games with small pieces, knives, cleaning products, and other examples known and unknown pose safety issues for children. The Lead Renter and the Rental Group claims understanding, acceptance, and responsibility for these risks upon booking.
21. Smoking/Vaping: This is a NON-SMOKING Property. No smoking of any kind is permitted in or around the immediate vicinity of the Property. Evidence of smoking of any kind, such as the smell of cigarette or cigar smoke inside the unit by the cleaning crew is sufficient basis to charge the Lead Renter for smoke clean-up and removal from A/C ducts, filters, walls, ceilings, and furniture. This type of clean-up is expensive and the Lead Renter is liable for the costs. Smoking must be done off property, at or beyond the public sidewalk. Cigarette butts or evidence of smoking products must be deposited in a proper waste receptacle outside of the unit. If smoking products such as cigarette butts are found on the grounds, Lead Renter will incur a charge for grounds clean-up.
22. Candles/Incense: The burning of candles or incense is not permitted within the Property.
23. Internet Access and Cable TV: Internet Access (Wireless Wi-Fi) and cable are provided in the units. Internet (Wireless Wi-Fi) and cable are provided by a 3rd party contractor. Shorebirds Beach Cottages of Manasota Key LLC is not responsible should the Internet (Wireless Wi-Fi) and/or cable become unavailable during your stay. We will, however, work with the providing vendors to try and resolve the issue as quickly as possible.
24. Parking: Parking is limited to two (2) vehicles (i.e., cars, small trucks). This limit includes vehicles of the Lead Renter, Rental Group and any day visitors. Vehicles are to be parked in driveways at the front of the Property only. Parking on the road, sidewalk, pavers or underneath the carport is not permitted. The Lead Renter and Rental Group may NOT store or park a recreational vehicle, commercial vehicle, boat or jet ski, or other watercraft, nor trailers of any kind on the Property premises without Rental Agent/owner permission. The Lead Renter is responsible for notifying Shorebirds Beach Cottages of Manasota Key LLC management if additional parking is needed. Additional vehicles may be parked at Englewood Public Beach parking area. Any illegally parked cars or vehicles that exceed the limit as stated above are subject to towing; applicable fines/towing fees are the sole responsibility of the Lead Renter and vehicle owner.
25. Misconduct: Please be respectful to the neighbors around you. Excessive noise and/or misconduct by you or anyone else in your party will not be tolerated. Excessive noise also includes but limited to loud voices, music and barking dogs. The Lead Renter and Rental Group should not create excessive noise at a level that disturbs neighbors. Code-enforced neighborhood quiet hours are from 10:00 p.m. – 8:00 a.m. The Lead Renter and Rental Groups are not allowed any of the following: immoral, offensive or unlawful purposes, nor violation of any law, association rules or ordinance, nor to commit waste or nuisance on or about the Property. Guests shall use property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person shall be cause for termination of this agreement, immediate removal from property with no refund of rents or deposits.
26. Garbage & Recycling: Any garbage or recycling must be placed in the proper garbage or recycling receptacles, located on the carport or rear of the Property. Pick-up day is Tuesday for all garbage and recycling. Please place all garbage and recycling in proper receptacles on or before Monday evenings.
No cleaning of fish, fishing equipment or coolers that contained fish on property. Do not store fish in refrigerator. Any fresh catch fish shall be cleaned off-site and cooked within one day. Lead Renter will be charged an extra cleaning fee of double the cleaning fee for failure to comply with the above.
27. Access: Shorebirds Beach Cottages of Manasota Key LLC management reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters, maintenance vendors, or other authorized persons. If Shorebirds Beach Cottages of Manasota Key LLC management has a reasonable belief that there is imminent danger to any person or property, management may enter the Property without advance notice.
28. Equipment and Furnishings: Equipment is provided at the discretion of Shorebirds Beach Cottages of Manasota Key LLC and attempts to ensure that such equipment is in working order for the duration of the rental period. Should a breakdown or some other situation occur that renders non-essential element unusable, Shorebirds Beach Cottages of Manasota Key LLC does not take responsibility for replacing or refunding the Lead Renter or Rental Group for the lack of use of this equipment. The equipment and facilities referred to includes (but are not exclusive to) such items: televisions, outdoor fire pits, bikes, kayaks, and paddle boards. Units are equipped with dishes, cookware, flatware, glasses, and appliances. All items in our Rental Property belong to Shorebirds Beach Cottages of Manasota Key LLC. Do not remove anything from the Property except for bikes, kayaks, paddle boards, and beach equipment. Bicycles, kayaks, paddle boards and beach equipment shall not leave the property in/on any kind of vehicle. Do not move furniture to a different location within the unit, or take inside furniture, outside. Under no circumstance may a stove, oven, or range be used as a source of heat. The Lead Renter must report any broken, inoperative or defective equipment or furnishings to Shorebirds Beach Cottages of Manasota Key LLC management promptly. Shorebirds Beach Cottages of Manasota Key LLC management will make every reasonable effort to have repairs made as soon as possible. Every attempt will be made to ensure that all the advertised equipment and appliances are in working order at the commencement of a rental period, no reduction of rent; rebate; or refund will be issued for a mechanical failure of air conditioning, dishwasher, washer, dryer, TV, or other appliances or amenities on the Property.
29. Fire Extinguishers & Smoke Detectors: The Lead Renter must report any malfunction with smoke detector(s) immediately to the Rental Agent. The Guests agree not to remove, dismantle or take any action to interfere with the operation of the smoke detector(s) installed on the Property. The Rental Agent has provided fire extinguisher(s) under the kitchen sink for your safety. Guests may not misuse, test, dismantle, block or remove the fire extinguisher. The Lead Renter must report to the Rental Agent any use, malfunction or repair required. In the event of the negligent use of the extinguisher(s), the Lead Renter will be responsible for any damage to the Property as well as the replacement or refill of the fire extinguisher.
No fireworks or other hazardous materials shall be used in or around the property.
30. Propane Grills: Propane Grills are available for guest use in the backyard common area. Please use caution when grilling. Lead Renter and Guests agree not to leave any grill unsupervised when in use and understand the closest fire extinguisher is located in the Laundry Room or under the sink in your cottage in case of fire. Please be sure to clean the grill before you leave, so the next guest finds it ready for use. Please DO NOT move the grills. We make our best efforts to ensure that propane tanks are refilled as needed; however, we cannot guarantee propane tanks have sufficient propane upon your arrival. Please contact Shorebirds management if the propane tank seems to be getting low, as delivery of a new propane tank may take up to 24 hours.
31. Bicycle Waiver: Lead Renter and Rental Group acknowledge that any bicycle equipment on-site is used as-is and that Shorebirds Beach Cottages of Manasota Key LLC, the Property owners, and their successors, assigns, employees or representatives, officially or otherwise is not responsible for any accidents or injuries or deaths arising from use of equipment. Lead Renter and Rental Group assume full responsibility for use of bicycles. Lead Renter and Rental Group acknowledge that they have a duty to inspect the bicycles prior to use to assure that it is in a safe and proper condition for use. Children will be supervised at all times while using bicycles and children must not use adult sized bicycles for their safety. Shorebirds management strongly recommends that Guests take responsibility to wear proper bicycle safety equipment at all times when using bicycles.
Bicycle use during the rental period is for the exclusive use of registered guests of Shorebirds Beach Cottages LLC. Lead Renter and Rental Group acknowledge that as a shared amenity with other guests of Shorebirds Beach Cottages, visitors may not use any of the amenities provided, including bicycles. Bicycles may not be removed from the property in/on any type of vehicle. Bicycles must be returned to the carport after each use, so that other guests may have access.
32. Kayak and Paddle Board Waiver: Lead Renter and Rental Group acknowledge that any boating equipment on-site is used as-is and that Shorebirds Beach Cottages of Manasota Key LLC, the Property owner, and their successors, assigns, employees or representatives, officially or otherwise is not responsible for any accidents or injuries or deaths arising from use of equipment. Lead Renter and Rental Group assume full responsibility for use of kayaks and paddle boards. Lead Renter and Rental Group acknowledge that they have a duty to inspect the kayaks and paddle boards prior to use to assure that it is in a safe and proper condition for use. Children will be supervised at all times while in watercraft. Lead Renter and Rental Group agree to wear life jackets at all times when in any watercraft.
Lead Renter and rental group acknowledge that kayaks and paddle boards are for the exclusive use of registered guests of Shorebirds Beach Cottages LLC only. Kayaks and Paddle Boards may not be removed from the property in/on any type of vehicle. Kayaks and Paddle Boards must be returned after a reasonable amount of time, not to exceed 4 hours, so that others may have access to the amenity.
33. Refunds: If a breakdown should occur to fundamental elements such as water systems, plumbing and electrical systems, and major appliances such as stove or refrigerator, every effort will be made to repair or replace, or an appropriate refund will be made for the inconvenience caused. This does not apply to system breakdown caused by misuse, such as plumbing blockages caused by inappropriate use of sanitary facilities. It is the Lead Renter’s responsibility to notify Shorebirds Beach Cottages of Manasota Key LLC management immediately if there are any problems. Shorebirds Beach Cottages of Manasota Key LLC management is not liable, nor will provide a refund, for any stoppage of electrical services caused by extreme weather or other circumstances beyond their control. Similarly, there will be no refunds for inclement weather, changes in water levels, conditions at neighboring properties, or any nuisance afforded by the natural elements of the location such as flying insects, or the animal population. If you are concerned about the possibility of a last-minute cancellation or early departure, Shorebirds Beach Cottages of Manasota Key LLC management strongly recommends that you take responsibility for this risk and purchase travel insurance.
34. Locked Owners Closet: Certain areas in and around the Property are locked for the owners personal storage and are not included in the rental agreement, including the closet in the laundry room and the shed on the carport. They are not to be tampered with or opened whether locked or unlocked. Any attempt to enter locked areas is cause for immediate termination of this agreement, forfeiture of all monies paid, and Lead Renter and Rental Group will be liable for any damage and/or missing items.
35. Other Conditions of Booking: The Lead Renter shall abide by these Terms and Conditions of Rental Agreement and any other instructions contained in the individual Welcome Guide and any additional information and instructions as shall be supplied in the rental unit or by The Owner.
36. Risk of Loss and Indemnification: LIMITATIONS OF LIABILITY: The Lead Renter represents, warrants, acknowledges and agrees with Shorebirds Beach Cottages of Manasota Key LLC management that he/she will use the Property and its facilities in accordance with The Terms and Conditions above and the Information provided and that he/she does so at his/her own risk. The Property is privately owned; the owners of the Property do not assume liability for the loss, theft, damage or injury (or death) to persons or their personal property. The Lead Renter hereby covenants and agree to indemnify and hold harmless Shorebirds Beach Cottages of Manasota Key LLC and their Agents, owners, successors, employees, and contractors from any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by the Lead Renter, Rental Group, permitted guests, visitors or agents, representatives or successors of the Lead Renter due to any claims relating to destruction of property or injury to persons and pets or illness to persons and pets or loss of life sustained by The Lead Renter, Rental Group, or family and visitors of the Lead Renter in or about the Property and Lead Renter expressly agrees to save and hold Rental Agent harmless in all such cases.
37. Release: The Lead Renter and Rental Group hereby waives and releases any claims against Shorebirds Beach Cottages of Manasota Key LLC, the Property owner, and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by the Lead Renter and Rental Group on or near or adjacent to the Property, including any common facilities, activities, or amenities. The Lead Renter and Rental Group agrees to use any such facilities or amenities entirely at the Lead Renter and Rental Groups own initiative, risk and responsibility.
ADDITIONAL TERMS TO THE RENTAL AGREEMENT
In addition to the standard terms included herein, the Lead Renter acknowledges and agrees that the following additional terms and conditions apply to the Lead Renter’s rental of the Property:
GENERAL PROVISIONS
This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Lead Renter and the Rental Agent. This Agreement shall be governed by the laws of the State of Florida. The words “Rental Agent” and “Rental Applicant” and “Lead Renter” and “Rental Group” and “Guest” shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. Please Note: Shorebirds Beach Cottages of Manasota Key LLC must receive your acceptance of the Terms of Agreement in order to completely secure your reservation within three (3) days of being sent to the Rental Applicant electronically via email.
ACKNOWLEDGMENT – The parties hereby understand and accept the terms and conditions on all pages of this agreement, as evidenced by the signatures set forth below. Execution of a digital signature shall be deemed a valid signature.
I have read and agree to the conditions and policies set forth in the Shorebirds Beach Cottages of Manasota Key LLC Rental Agreement. Acceptance by facsimile or email shall constitute valid binding acceptance of this Lease Agreement.
